RACsuccess provides this website and all related services including One-On-One will be subject and bound to the following terms and conditions.  Usage of this site implies a clear and knowledgeable agreement to these conditions and binds you to abide by any and all guidelines set forth.

Web Site Usage

RACsucces provides this website for usage by all interested parties.  Actual accounts are required to be the sole property of a single account holder and may not be shared under any circumstances.  Each member is barred from sharing personal details of their account with other members or perspective members for any usage.  All content, images and videos contained on the site are the sole property of RACsuccess and all copyright remains in our possession.

Reasonable attempts and efforts will be made to keep the website and all services available for usage at all times, however there are times when this could be out of our control.  We are not liable for any damaged or perceived damages that result from this situation.  Additionally, while all attempts are made to ensure that contents are all accurate, it is possible that mistakes are made.  Any errors that are discovered will be corrected at the soonest possible time and we request that you notify us with any errors.

Additionally, due to the internet and the nature thereby implies as well as the possibility of third party interference, this website is not guaranteed to be free of all viruses and technical defects of any type.  We are not liable for any damage or loss caused by such third party interference as a result of your usage of RACsucces sites.

All pages, graphics, videos, images, and content not previously mentioned that is located on the RACsuccess and On-on-One site are the sole property of RACsuccess.  All copyright is held exclusively and materials are not allowed to be reproduced, distributed, redistributed, or modified.  Any usage of materials will only be granted through specific written permission after a written request is received.  Permission will be considered and granted or declined through the sole discretion of RACsuccess.

All information shared, including questions, solutions to requests, submissions, and bid requests are the exclusive copyright of RACsuccess and can be used by RACsuccess at anytime for any reason without further notice.  At the discretion of RACsuccess credit for the original submission or text can be given.

Submissions

One-On-One operates through the usage of members submitting submissions to the mentor of their choice.  Submissions are considered one of three different types of transactions.  They include ask a mentor to write a bid request or initial comment, ask a mentor a question in regards to how to use Rent A Coder, or finally asking for advice from the mentor on how to handle a situation on Rent A Coder as either a buyer, or a seller.  Additional submission types may become available in the future and will also be included in this definition.

Warranties

All services, content and mentoring services are provided without warranty of any kind.  Members usage of the information is taken upon at their own risk, mentors are not responsible for any damages that can incur whether real or perceived.  We are not liable for any damages, perceived damages or actual damages that can occur from the usage of our products and services. RACsuccess will not be held liable for any damage or perceived damage caused by RACsuccess-One-On-One B-InTouch messenger software application and will not be held liable for any perceived or real damage caused by the use of the RACsuccess package (product we sell on our website).

Prohibited Use

You agree by using this site that you will not use any of the products, the site, the services, the member or anything else offered or provided for any illegal purposes.  All users of the site additionally agree that they will not use any of the services to help encourage or condone illegal behavior.

Additionally, mentors are barred from sharing contact information with the member that has selected chosen to work with them.  This includes but is not limited to: telephone numbers, e-mail addresses, instant messenger nicknames, or website addresses.  Mentors found to be in violation will have their account closed and monies due forfeited.

Furthermore, mentors are not allowed to exchange telephone numbers, e-mail addresses, instant messenger nicknames or website addresses on their background information since this information is displayed to anyone that visits our site. Mentors found to be in violation will have their account closed and monies due forfeited.

Conduct

While using the One-On-One services including mentor assistance all members agree to conduct themselves in a professional manner.  This includes:

?         Restrict anyone else from using your account.  You are personally responsible for your membership details; accounts that are shared will be terminated.

?         Refrain from posting any materials, content, questions or items that are illegal, or pertain to illegal activity.

?         Avoid using any profane or abusive language with RACsuccess staff as well as One-On-One members who are assigned to your account.

?         Refrain from violating another member, mentor or person?s copyright.

?         Submit or transmit information, content or documents that contain a virus or other malicious software.

Steal projects from members: Mentor is allowed to bid on the same projects on which they assist members with their initial comment submissions. However, mentor is not allowed to make their proposals better or more effective than the ones that they wrote for member.

This means that mentor's proposals for projects must be LESS effective but keeping in mind that mentor still has the chance of getting the project given his/her strong reputation(ratings and comments) in Rent a Coder. This is to ensure that mentor can work on the submission and bid on the project if they qualify for it thus ensuring a faster assistance to member for his/her submissions and a fair process of giving the chance to member to win that bid.

Mentor is not allowed to mislead member in order to obtain the member's project.

RACsuccess reserves the sole right to delete, suspend, or terminate the account of anyone who fails to follow proper conduct.  Any user who is banned, suspended or terminated who creates a new account will be banned from the site permanently.

Trademark Information

RACsuccess is a registered trademark of RACsuccess.com.  You are not permitted to use the trademark without proper written permission from RACsuccess.

Mentor of the Month

In the event that you become mentor of the month, RACsuccess reserves the right to put a picture of you as well as some of your background information on our home page. Your picture and background information will also appear to all mentors available on the system as soon as they login to their account and you agree to accept this.

What do some of our mentors say?

RACsuccess reserves the right to put a picture of you in any page of our website along with part of the information that you provide in your background information on your profile. We randomly select mentors to appear on our pages so if you are chosen to appear, you will not be notified of this and you agree to accept this.

This website contains hyperlinks to some sites, which are not owned, operated or controlled by RACsuccess.  Such links are provided solely for your reference only and are not the responsibility of RACsuccess.  The inclusion of these links does not imply an endorsement, approval, stake of claim or any other implications for the material that is presented there.

Mentors Responsibilities

In accordance with the packages/membership packages that are offered, when selected by a member you agree to offer the services that are requested of you at the rates set for.  Mentors agree to assist members in writing up initial bid submittals, responses to buyers, answer questions about the site and also assist in advice sessions if requested from members who have chosen you as their chosen mentor.

As a mentor for RACsuccess and One-On-One you are a representative of the company and the site.  As such, you are expected to act in a mature and professional manner.  While all mentors are independent contractors, they are still required to respect the One-On-One processes, procedures and rules.

Submission Closures

RACsuccess reserves the exclusive right to close any submissions that are required due to misuse, abuse or neglect from either a member or a mentor without notice.  In the event that it becomes necessary for RACsuccess to close a submission it is possible that a mentors account can be closed it they are abusing the service. 

Dropping Members

Mentors are allowed to decline members at any time they choose.  

Employment

As a mentor for One-On-One and RACsuccess you agree that you are an independent contractor and as such you are not entitled to hourly wages, weekly wages, employment benefits, or W-2 form for tax purposes.  Mentors are accepted into the program as an independent contractor and as such are only paid for the submissions that are completed successfully from members.  Tax information will be required from each mentor residing in the United States of America or those American citizens whom are living abroad in the form of a social security number or Tax ID number.  Additionally, RACsuccess will not be subject to any withholding orders, wage assignments, income taxes, social security taxes or any other standardized deductions.  Mentors are solely responsible for the payment of these fees entirely on their own accord.

Changes and Modifications

At times as necessary RACsuccess reserves the exclusive right to modify the terms and conditions without previous notice.  Notification of changes will be made available both in an announcement onsite as well as sent by e-mail notification to all members alerting them to changes made.  Changes that are made will not require prior notification, and are at the sole discretion of RACsuccess.


Changes and additions to our Mentor Terms and Conditions:

April 28, 2009:

We changed the part that talks about stealing projects from members. We changed it to this:
